Mr.Ram Naresh Ray, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SANDEEP KUMAR ORAL ORDER 22-05-2023 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Bidupur P.S. Case No. 421 of 2021 for the offence under Sections 147, 341, 323, 307, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner has got three criminal antecedents and he is in custody since 24.01.2023.

As per the prosecution case, the petitioner along with others was heading towards his old house-and abused & assaulted the informant. Further, accused Chhotu Kumar threatened to kill him and handed pistol to Harinarayan Singh (petitioner) .Thereafter, petitioner shot the informant and the bullet hit slightly above the right knee and blood oozed out and he fell down.

The petitioner, named above, is directed to be released on bail after framing of charge or after completing of six months of custody whichever is later on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Bidupur P.S. Case No. 421 of 2021.
