JUSTICE SUDHIR SINGH ORAL ORDER 20-12-2016 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case instituted for the offences under Sections 302 and 201/34 of the I.P.C. Allegation against the petitioners is that they committed murder of the son of the informant due to previous enmity. It has been submitted on behalf of the petitioners that the petitioners are in custody since 23.9.2016 and 28.8.2016 respectively and the charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have falsely been implicated in the present case. It is a case of last seen. There is no substantive evidence to suggest his implication in the present case. On behalf of the State, it is submitted that the

Considering the aforesaid facts and circumstances, it is directed that the petitioners above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Maheshkhut P.S. case No.58 of 2016.
