The petitioner is apprehending his arrest for the offences punishable under Sections 420/34 of the Indian Penal Code.
It has been submitted on behalf of the petitioner that he executed a sale deed in favour of the complainant with regard to the land which was already sold by him to another person. The petitioner and the husband of the complainant are own brothers. There is dispute between the parties with regard to share of the property.
Heard learned A.P.P. also.
In view of the facts and circumstances of the case,
Patna High Court Cr.Misc. No.14833 of 2017 (2) dt.04-04-2017 2/2 let above named petitioner, in the event of his arrest/surrender in the court below within a period of six weeks from today, be released on bail on furnishing bail bond of Rs. 25,000/-(twenty five thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IIIrd, Araria, in Complaint Case No. 403 of 2014, subject to the conditions as laid down u/s 438(2) Cr.P.C. with a further condition that the petitioner shall co-operate in the trial and appear on each and every date fixed by the trial court and failure on two consecutive dates without showing any reason will make him liable for cancellation of his bail bonds.
