The instant writ petition has been filed by the petitioner for direction to the respondents to dispose off the application filed by the petitioner in prescribed format along with required documents and demand draft of Rs. 11,000/- (as fee) for grant of license of wood based industries, which is kept pending in the office of respondent no. 2 from 01.02.2018 and also for direction to the respondents to grant license for wood based industries up to 24" diameter wood including saw pit.

Learned counsel for the petitioner has submitted that petitioner is manufacturing wood product under the entrepreneurs

Patna High Court CWJC No.7330 of 2019 dt.10-04-2019 2/3 memorandum no. 100061100390 part II issued on 03.05.2014 in the name of "Vishakarma Furniture Udyog". Petitioner has been presently issued a license for manufacturing of wood of 18" diameter. The respondents always gave him threat that he has used more than 18" diameter wood for the manufacturing of the wood products.

It is further submitted that petitioner has filed application form for the use of up to 24" diameter wood under the provisions of Bihar Wood Based Industries (Establishment and Regulation) Rules, 2017 on 01.02.2018. The petitioner has filed several representations before the concerned authority for grant of license. Copy of aforesaid representation dated 04.10.2018 is annexed as Annexure-4.

Learned counsel for the petitioner has submitted that several times petitioner visited the office of the respondents but his representation has been kept pending.

Learned counsel for the petitioner has further submitted that petitioner has been manufacturing the wood product under Udyog Aadhar Registration Certificate 100061100390 Part II issued on 03.05.2014 in the name and style of "M/s Vishakarma Furniture Udyog".

Patna High Court CWJC No.7330 of 2019 dt.10-04-2019 3/3 In such circumstances, this writ petition is disposed off with direction to Respondent no. 2 to pass appropriate order in accordance with law on the application filed by the petitioner for grant of license as contained in Annexure-1, which is still pending, after giving proper opportunity of hearing to the petitioner and looking into all the relevant documents, within a period of three months from the date of receipt/production of this order.
