JUSTICE SATYAVRAT VERMA ORAL ORDER 06-01-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. The petitioner seeks bail in a case registered for the offences punishable under Sections 304(B) and 34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is in custody since 24.08.2021, is a person with clean antecedent and is father-in-law of the deceased and the husband of the deceased is in custody, it is next submitted that from perusal of the allegation as alleged in the FIR, it would manifest that the allegation of demand of dowry and torture is general and omnibus in nature, it is further that whenever any dispute arises between the husband and wife leading to death of the
Patna High Court CR. MISC. No.21125 of 2022(3) dt.06-01-2023 2/2 wife, the entire family members are implicated. Learned A.P.P. for the State opposes the prayer for bail of the petitioner.
Considering the fact that husband of the deceased is in custody, is a person with clean antecedent and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Saraiya P.S. Case No. 598 of 2021.
