2. The petitioner apprehends his arrest for the offences alleged under Sections 363, 366, 506 and 34 of the Indian Penal Code, registered in connection with Sanokhar P.S.Case No. 109 of 2024.
3. At the outset, the learned counsel for the petitioner has submitted that the victim did not support the prosecution case in her statement under Section 183 of the BNSS. She has stated that she solemnized her marriage with the petitioner. In the last paragraph of her statement under Section 183 of the BNSS, she has stated that she wanted to go with the petitioner. The victim has stated her age as 17 years, and according to her educational certificate, her date of birth is 14.12.2007. Her
Patna High Court CR. MISC. No.20616 of 2025(4) dt.24-09-2025 2/2 educational certificate shows that she is on the verge of majority.
4. On the other hand, Mr. Shailendra Kumar, the learned APP for the State, has opposed the prayer for anticipatory bail, but conceded that the victim did not support the prosecution case.
5. Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-XI, Bhagalpur in connection with Sonakhar P.S.Case zNo. 109 of 2024, subject to the conditions as laid down under Section 438(2) CrPC/482(2) of the BNSS, 2023.
