The petitioner seeks bail in connection with Amba P.S. Case No. 15/2015, registered for the offence punishable under Section 302 of the Indian Penal Code.
The petitioner wants to renew the prayer of bail which was earlier rejected by order dated 08.03.2016 passed in Cr. Misc. No. 54118/2015 on the ground that the petitioner is suffering in custody since 23.02.2015 having no criminal antecedent. There is no eyewitness of the occurrence and only on suspicion the petitioner has been named.
Learned A.P.P. opposes the prayer of bail by submitting that the deceased before his death has stated that the petitioner has
Patna High Court Cr.Misc. No.51720 of 2016 (3) dt.18-01-2017 2/2 assaulted him after providing drink and further the petitioner took away the deceased.
In the facts and circumstances stated above, finding no good ground for re-consideration of the prayer of bail, again the prayer of bail of the petitioner stands rejected. However, considering the detention of the petitioner, let the trial be expedited and concluded as early as possible preferably within four months from the date of receipt/production of a copy of this order.
