In the present writ application, the petitioner has prayed for direction commanding upon the respondents to stop construction work, thereupon demolish the illegal construction, which has been made by Respondent Nos.6 and 7 on Gairmazarua Aam Bandh land on Kheshra Plot No.393 in Khata No.108 under Mauza Sripalpur, Punpun Circle, Patna. The petitioner has further prayed for direction commanding the Respondent No.1 to 5 to establish right of ways/right of

Patna High Court CWJC No.6636 of 2019(2) dt.03-04-2019 2/2 easement to petitioner by acting legal recourse upon respondent No.6 to 8.

The petitioner is aggrieved by the encroachment being made on the public land. The petitioner had filed an application on the earlier occasion also, but no action has been taken on the part of the Respondent No.5.

Considering the aforesaid facts, the petitioner is directed to file a fresh application/representation with all details before the Respondent No.5, i.e. Circle Officer, Punpun, District Patna within 30 days from today. The Respondent No.5, i.e. Circle Officer, Punpun, District Patna shall consider the application/representation of the petitioner and pass an appropriate order in accordance with law, after giving opportunity to all concerned parties, within a period of five months from the date of filing of such application/ representation.

With the aforesaid observation and direction, the present writ application stands disposed of.
