The petitioner seeks bail in Hisua P.S. Case No. 164 of 2014, corresponding to Sessions Trial No. 46 of 2015/07 of 2016, registered for the offences punishable under Sections 302, 201 and 34 of the Indian Penal Code.
The informant alleged that his sister was married with the petitioner about ten years ago. His sister got three children but the petitioner was threatening the deceased to kill and marry with another girl. It is alleged that the petitioner killed his wife and hurriedly cremated the dead body.
Learned counsel for the petitioner submits that there is no witness of the occurrence. The petitioner is in jail since 25.08.2014, but it appears that it was the petitioner who killed his
Patna High Court Cr.Misc. No.39876 of 2016 (3) dt.05-12-2016 2/2 wife and hurriedly cremated her dead body. The investigating officer has not even taken the statement of the children of the deceased who are residing with the deceased.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on bail. Accordingly, the same is rejected.
As the petitioner is in jail since 25.08.2014, the trial court is directed to hold the trial on day-to-day basis and conclude the same within six months.
