JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-07-2019 This is an application for grant of anticipatory bail in connection with Sonbarsa P.S. Case No.91 of 2016, disclosing offences under Sections 323, 498A, 494, 379 of the Indian Penal Code and Section 3⁄4 of Dowry Prohibition Act. Case is under Section 498-A of the IPC.

On appearance of the opposite party no. 2, the matter was referred to the Mediation Center, Sitamarhi, vide order dated 07.05.2019. The report of Mediator is available on record at Flag "A" which disclosed that the a petition has been filed by the petitioner that he will keep her with dignity and care and take her from the court.

Submission of learned counsel for the petitioner is that after the mediation she is residing with the petitioner. Learned counsel for the opposite party no.2 has also not controverted the above facts.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Additional Chief Judicial Magistrate, Sitamarhi, in connection with Sonbarsa P.S. Case No.91 of 2016, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition that he is to keep her with dignity and care.
