JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-06-2022 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor representing the State. The petitioner apprehends arrest in a case registered for the offence punishable under section 324 and other ancillary sections of the Indian Penal Code and section 7a of the PC Act. Prosecution's case, in brief, is that the petitioner and other accused persons helped a convict in fleeing away from the ward of hospital.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner's name has figured during course of investigation in confessional statement of co-accused arrested on the spot. No other substantive evidence has been collected

In the facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge I Bhagalpur in Kotwali Barari Police Station Case No. 727 of 2019, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
