JUSTICE SUDHIR SINGH ORAL ORDER 29-09-2015 Heard learned counsel for the petitioner and learned counsel for the State The petitioner is apprehending his arrest in connection with Puraini P.S. Case No. 104 of 2014 for the offences instituted under Sections 467, 468, 471, 420 and 409/34 of the IPC. The prosecution story, in brief, is that the allegation against the petitioner and other co-accused persons as named in the F.I.R. is that they have withdrawn the amount of loan from the Bank by showing forgery in K.C.C. and G.C.C. Schemes in the Bank in the name of the informant and several other persons. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It is further submitted that the petitioner has been made accused due to mistake of fact. It

Patna High Court Cr.Misc. No.39533 of 2015 (2) dt.29-09-2015 2/2 is further submitted that no such loan has been sanctioned in favour of the petitioner. Other co-accused have been granted bail by this Court vide Cr. Misc. Nos. 17262/2015 and 42474/2015. On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of four weeks from today in connection with Puraini P.S. Case No. 104/2014 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Madhepura, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
