This application for regular bail arises out of Sitamarhi Government Official Case No. 33 of 2020, disclosing offence punishable under Sections 30(A) of the Bihar Prohibition and Excise Act, 2016.

It is alleged against the petitioner and the co-accused that when they were coming from the border of Nepal in a motorcycle they were intercepted and from their possession 45 litres of Nepali saufi wine is said to have been recovered. Learned counsel for the petitioner has submitted that the seizure memo does bear the signatures of the petitioner and co-accused from whose possession the wine was allegedly recovered. Considering the nature of accusation and the quantity of liquor said to have been recovered, this application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned Special Judge Excise, Sitamarhi in Sitamarhi Government Official Case No. 33 of 2020.
