The Opposite parties are accused of offence punishable under Sections 147, 148, 149, 363, 364, 365/34 of the Indian Penal Code. They have been allowed anticipatory bail by learned Additional Sessions Judge-II, Sitamarhi in connection with concerned Runnisaidpur P.S. Case No. 95 of 2016. The petitioner seeks cancellation of bail so allowed by the Court below.
From the impugned order and the complaint petition, which is the basis for registration of the First Information Report,
it appears that the petitioner, who is the informant of the case is father-in-law of Opposite party No.2. Opposite party No.2 has filed case against her husband and family members including the petitioner under Section 498A of the Indian Penal Code. The registration of the First Information Report on the basis of the complaint case is apparently result of matrimonial dispute between the Opposite party No.2 and her husband.
No case for cancellation of bail is made out. This application has no merit and it is, accordingly, dismissed.
