====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 29-03-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Excise Act Case No. 521 of 2018 arising out of Teghra P.S. Case No. 356 of 2018, instituted for the offence under Section(s) 30(a), (b) of the Bihar Excise (Amendment) Act, 2018.

Counsel for the petitioner submits that there is no recovery of any foreign liquor from possession of the petitioner. The recovery has been made from premises of co-accused Sanjeev Raman. The police has found Sanjeev Raman and his other family members in the house at the time of unloading the liquor from the truck. They disclosed the name of this petitioner before the police.

As such, mere suspicion has been raised against the

Petitioner is in custody since 23.02.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge (Excise Act), Begusarai, in connection with Excise Act Case No. 521 of 2018 arising out of Teghra P.S. Case No. 356 of 2018, subject to the condition that both the bailors will be close relatives of the petitioner.
