JUSTICE BIRENDRA PRASAD VERMA ORAL ORDER 01-09-2015 The petitioner is aggrieved by the order dated 07.01.2011 (Annexure-1) passed in Mutation Revision Case No.862 of 2004-05 by the Additional Collector, Katihar, whereby the aforesaid revision case filed on behalf of the petitioner has been dismissed and the order dated 04.03.2004 (Annexure-2) passed in Mutation Appeal No.173 of 2003-04 by the D.C.L.R., Katihar has been affirmed.

In the considered opinion of this Court against the order impugned, the petitioner has an alternative and efficacious remedy before the learned Bihar Land Tribunal, Patna in view of the provisions contained in Section 9 of the Bihar Land Tribunal Act, 2009.

Patna High Court CWJC No.5499 of 2011 (5) dt.01-09-2015 In above view of the matter, the learned senior counsel appearing on behalf of the petitioner seeks permission to withdraw the present writ petition with a liberty to approach the learned Bihar Land Tribunal, Patna for grant of appropriate relief(s). Permission is accorded.

The writ petition stands dismissed as withdrawn with the liberty aforesaid.
