JUSTICE SANJAY PRIYA ORAL ORDER 01-11-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Supaul P.S. Case No. 241 of 2000 (Sessions Trial No. 49 of 2001) instituted for the offence under Sections 341, 323, 324, 307, 379, 504 and 34 of the Indian Penal Code.

Counsel for the petitioner submits that it is a case of misuse of privilege of bail.

From the impugned order it appears that bail bond of the petitioner was cancelled on 29.06.2007 and process under Sections 82 and 83 Cr. P.C. was issued. Petitioner has surrendered on 1.9.2018 and since then he is in custody. The petitioner has been sufficiently punished for laches committed on his part. Therefore, prayer for bail of the petitioner

Patna High Court Cr.Misc. No.65120 of 2018 (2) dt.01-11-2018 2/2 is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Supaul, in connection with Supaul P.S. Case No. 241 of 2000 (Sessions Trial No. 49 of 2001), subject to the condition that both the bailors will be the close relatives of the petitioner.
