2. The petitioner seeks bail in connection with Jokihat P.S. Case No. 648 of 2022 dated 27.12.2022, instituted for the offence punishable under Sections 304(B)/34 of the Indian Penal Code.

3. The allegation against the petitioner is that the informant based on information visited matrimonial house of her daughter where she found the dead body of her daughter in a room locked from inside and no family member were present. It is further alleged that her daughter who was married for six years, was assaulted by her mother-in-law and husband.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he is falsely implicated in this case. It

No.21678 of 2023(2) dt.18-05-2023 2/2 is further submitted that petitioner is the elder brother of the husband of the deceased and living separately from his brother i.e. husband of the deceased. As per the prosecution's case, the dead body was found inside a locked room. The learned counsel for the petitioner submitted that the deceased herself locked in the room and body was recovered after breaking the door. Lastly, it has been submitted that the petitioner is in custody since 28.12.2022, has one criminal case and charge-sheet has been submitted in the case.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in Jokihat P.S. Case No. 648 of 2022.
