The petitioner is accused in connection with Tajpur P.S. Case No. 232 of 2016 registered under sections 342, 307 and 498(A) of the I.P.C. and later on, section 302 of the I.P.C. was added pending in the Court of A.C.J.M.-I, Samastipur. The allegation is of cruelty and torture for nonfulfillment of demand of dowry by in-laws' family members. Thereafter, they tried to kill her by sprinkling kerosene oil. Learned counsel appearing on behalf of the petitioner submits that petitioner, who happens to be Bhaisur of the deceased, has falsely been implicated in this case due to dirty village politics. It is also submitted that petitioner is in custody

Patna High Court Cr.Misc. No.51325 of 2016 (3) dt.19-01-2017 2/2 since 25.07.2016.

Learned A.P.P., appearing on behalf of the State opposed the prayer of the petitioner with submission that there is direct allegation against the petitioner.

Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected. However, petitioner may renew his prayer for bail after framing of charge.
