Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 307, 323, 324 of the Indian Penal Code. It is alleged that six F.I.R named accused persons and ten unknown came various armed when specific accusation of causing injury on the head of the brother of the informant namely Vijay Singh is alleged against Om Prakash Singh(non-petitioner) and when he felled down then Nagdeo Singh assaulted with lathi when others also assaulted the brother of the informant.
It is submitted by learned counsel for the petitioners that only injury on the head of the brother of the informant which is alleged to have been caused by Om Prakash
Patna High Court Cr.Misc. No.46806 of 2014 (2) dt.24-04-2015 2/2 Singh(non-petitioner) has been found to be grievous.
Admittedly as per the First Information Report the occurrence took place in the background of serious land dispute and there is counter version of the occurrence also.
Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Mali P.S. Case No. 39 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
