JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-10-2016 Heard learned counsels for the petitioner and the State. The petitioner being husband of the informant is languishing in custody since 29.8.2016 in a case registered under Sections 341,323 and 498A/34 of the Indian Penal Code and sections 3 and 4 of Dowry Prohibition Act.

The basic accusation is of torture for non fulfillment of dowry demands.

It is submitted by the learned counsel for the petitioner that the petitioner admits his marriage with the informant and the petitioner is ready to keep the complainant as wife with full dignity and honour. Statement to that effect has been made in paragraph 8 of the petition which reads as follows: " That the petitioner is husband of the informant and always ready to keep his wife with full honour and dignity

It is further submitted that the mother of the petitioner filed Complaint Case No. 2548C of 2015 on 3.9.2015 against the informant levelling accusation under sections 323,354,364,365,452 and 120B IPC and thereafter the present case has been registered on 4.9.2015. The maintenance case no. 265 of 2015 filed by the informant has already been dismissed. Considering the nature of accusation and the present stand of the petitioner, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Araria in connection with Forbesganj P.S. Case No. 452 of 2015.
