JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 20-01-2022 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceedings. Learned counsel for the petitioner undertakes to remove the defects within four weeks of resumption of normal court proceedings. In the eventuality of non-removal of defects within stipulated period, office will place the matter before the Bench. The petitioner apprehends his arrest in a case in connection with Jalalpur P.S. Case No.187/2019, registered for the offence punishable under Sections 341, 323, 353, 504 and 506/34 of the Indian Penal Code.
The prosecution case in short is that the informant went to the house of one Sunaina Kuar and Ajay Sharma to check illegal use of electricity and found some irregularities. It is alleged that they tried to bribe the informant but on refusal they threatened

Thereafter, in the way, family members of Sunaina Kuar including the petitioner stopped the informant's vehicle in the way and assaulted him after abusing in caste name. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case at the instance of his enemies. No such occurrence as alleged has ever taken place. There is no specific allegation of assault attributed against the petitioner rather there is general and omnibus allegation against several villagers. The occurrence took place on 09.11.2019 but the petitioner, who is a Constable in the U.P. Government, went to Prayagraj to join his duty on 08.11.2019 and a certificate has been issued by the Police Officer of Prayagraj in the aforesaid subject on 04.02.2020. Petitioner has no criminal antecedent, as also mentioned in para-3 of this application. Learned APP for the State opposed the prayer for anticipatory bail.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of
