This is an application seeking modification of the order dated 09.10.2014 passed in Criminal Miscellaneous No.24188 of 2014 in connection with Dalsingsarai P.S. Case No.157 of 2014, pending before the ACJM, Dalsingsarai (Samastipur).
It is stated that the petitioner well within the stipulated period made attempts to deposit Rs.35,000/- in terms of the order aforesaid but due to non-cooperation of opposite party no.2 nothing could be done. Hence, in fourth paragraph of order dated 9th October 2014 after the words in the name of opposite party no.2, it may be treated inserted that "or by deposit in court which may subsequently be withdrawn by opposite party no.2 on undertaking to get the same deposited in post office or nationalized Bank for the period indicated above".
Further, as prayed for, the period to avail the liberty granted vide order aforementioned is extended till 22nd January 2015. (Akhilesh Chandra, J) Ashwini/- U T
