2. Petitioner seeks regular bail in connection with Punpun P. S. Case No. 389 of 2024 registered for the offences punishable under Sections 103(1), 61(2), 238 of the Bharatiya Nyaya Sanhita.
3. According to the case of prosecution, in this case, the name of the deceased is Santu Kumar. According to the information given by his father Navdeep Prasad Singh, on 23.11.2024, the deceased left his house along with accused Nawal Yadav but he did not return. His dead body was found lying near the railway track.
4. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.20589 of 2026(3) dt.17-07-2026 2/2 petitioner is not named in the F.I.R. and his name transpired during investigation in confessional statement of co-accused Mangaldeo @ Munna who has already been granted regular bail by co-ordinate Bench of this Court vide order dated 12.05.2025 passed in Cr. Misc. No. 14476 of 2025. Petitioner claims clean antecedent and is in custody since 11.09.2025. Charge-sheet has already been submitted.
5. However, learned A.P.P. for the State as well as learned counsel for the informant vehemently opposed the bail application.
6. Considering the nature of accusation, clean antecedent, period of custody and other facts and circumstances of the case, this bail application is allowed. The petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned SubDivisional Judicial Magistrate, Masaurhi (Patna) in connection with Punpun P. S. Case No. 389 of 2024.
