====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 14-07-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 308, 325, 379, 504, 506 and 34 of the Indian Penal Code.
The informant alleges that while he was returning from his college when he was intercepted by the accused persons including the petitioner and it is alleged that coaccused Chhotu threatened the informant by pointing his country-made pistol and thereafter petitioner assaulted him with an iron rod causing injury on head and right hand and thereafter all the accused persons assaulted the informant

Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and has been falsely implicated in the present case, it is next submitted that there is a land dispute relating to passage on account of which an altercation took place in which both side assaulted each other, it is further submitted that injury no. 1,2 3 and 5 are simple and injury caused on the hand is said to be grievous but then it is on non-vital part of the body and the allegation of assault is also against all the accused persons though it is alleged that this petitioner assaulted the informant by an iron rod causing injury on head but then the injury on head which is vital part of the body is simple in nature.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on
Patna High Court CR. MISC. No.23409 of 2023(2) dt.14-07-2023 3/3 anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Lakhisarai (Amahara O.P.) P.S. Case No. 27 of 2023 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
