Having regard to the fact that the learned counsel for the petitioner has failed to point out anything wrong in the impugned order of transfer of its being either without jurisdiction or contrary to the Rules, this Court does not find any reason to interfere with the same. That being so, this application is wholly misconceived and ill advised and is, accordingly, dismissed.

Before parting with, this Court must however

Patna High Court CWJC No.17395 of 2013 (4) dt.20-03-2015 make it clear that if the petitioner has been given promotion but he wants to remain on the same post after giving up his promotion he may have the liberty to do so, but even in that case he cannot claim to continue in the same place where he was /is posted prior to his promotion and posting.
