JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-04-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 406,420 and 504/34 of the Indian Penal Code.

It is alleged that the petitioner and his father agree to sale 2 kathas 10 dhoors of land to the informant for the purpose of marriage of his daughter for which informant paid rupees sixty thousand. Subsequently, neither the sale deed was executed nor the month was returned.

It is submitted by the learned counsel for the petitioner that there is no proof of payment of money and the petitioner side has lodged Complaint Case No. 449C of 2014 against the

Patna High Court Cr.Misc. No.46623 of 2014 (2) dt.17-04-2015 2/2 informant. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Bettiah, West Champaran in connection with Mainatand P.S. Case No. 34 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
