This is an application for the offence under Sections 25 (1b)A/26/35 of the Arms Act in connection with Matihani P.S.Case No.49 of 2016.
It is submitted on behalf of the petitioner that there is allegation of recovery of one Pistol and one cartridge and so far the antecedent of the petitioner is concerned, he is accused in 22 cases but out of them, in 11 cases, he has been acquitted, in 02 cases, final form has been submitted by the police and 09 cases are pending against him. The petitioner is in custody for more than nine months.
Heard learned A.P.P. also.
Having heard both sides. In view of the antecedent of the
Patna High Court Cr.Misc. No.931 of 2017 (3) dt.10-02-2017 2/2 petitioner, I am not inclined to grant bail to the petitioner at this stage, however, considering the fact that the petitioner is in custody for more than nine months, the learned trial court is directed to expedite the trial.
With the aforesaid observation, this application is dismissed.
