JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 08-02-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Earlier the prayer for bail of the petitioner was refused thrice, lastly on 6.4.2016 vide Cr.Misc. No.9292/16 with observation that the trial court will take effective steps to conclude the trial of the petitioner within six months but the trail has not yet been concluded as yet.

The report regarding stage of the trial, as called for vide order dated 11.01.2017 from the Ccourt of Additional Sessions Judge-XI,Patna, has been received through Letter No.15 dated 31.01.2017 which indicates that all the witnesses have been examined on behalf of the prosecution except two official
Patna High Court Cr.Misc. No.50860 of 2016 (3) dt.08-02-2017 2/2 witnesses related to Forensic Science Laboratory. Under the above facts and circumstances of the case, I am not inclined to reconsider the prayer of bail of the petitioner accordingly. His prayer for bail stands rejected. However, the trial court is directed to take effective steps for examination of the two remaining official witnesses and conclude the trial within a period of six months, failing which the petitioner will be at liberty to renew his prayer for bail.
