JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-11-2018 The petitioner seeks regular bail in connection with Azimabad P.S. Case No. 26 of 2018, registered for offences punishable under Sections 393, 307 and 34 of the Indian Penal Code.
Allegation as per F.I.R. is that while the informant was going along with the driver with a cash of Rs. 30 lacs, four to five miscreants stopped the informant and tried to commit loot from him and on protest by the informant, they fired, which hit the thumb of informant, anyhow he managed to save himself as well as the cash.
It has been submitted on behalf of the petitioner that he has falsely been made accused in this case on the confession of co-accused and except that there is nothing against the
Patna High Court Cr.Misc. No.66786 of 2018(2) dt.26-11-2018 2/2 petitioner. Further submission is that petitioner has been in judicial custody since 02.07.2018 and though he is an accused in one more case but in that case, he is on bail. Heard learned A.P.P. also.
Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bhojpur, Ara, in connection with Azimabad P.S. Case No. 26 of 2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
