This is an application for quashing of the order dated 29.5.2015 passed by the learned Additional Sessions Judge, IV, Aurangabad.
As per the prosecution story, the complainant alleged that Rs. 50,000/- was given to the accused and written agreement to sale his land was executed but the petitioner chose to sell the said land to another person and as he also failed to return the amount, legal notice was sent. He received the notice but as no reply was sent, the present complaint. After going through the facts of the case and materials
Patna High Court CR. MISC. No.38560 of 2015(2) dt.25-02-2023 2/2 on record, cognizance taken whereafter the petitioner preferred discharge application and the same too came to be dismissed. Accordingly, the petition.
Learned counsel for the petitioner submits that though not confirmed but probably, the trial stands concluded. She as such seeks liberty to raise all the points before the Trial Court at an appropriate stage if the Trial is still on The petition accordingly stands disposed of with the aforesaid liberty.
