Heard both sides.

The petitioners apprehend their arrest in Surajpura P.S. case No. 02 of 2017 under Section 323, 379, 506 and other Sections of the Indian Penal Code and under Section 27 of the Arms Act.

The informant named the petitioners along with other accused persons and alleged that on account of some dispute among the children the petitioners and other came. Munna Singh is alleged to have assaulted Shambhu Singh with Farsa on his head. Babloo Singh is alleged to have assaulted Shambhu Singh

Patna High Court Cr.Misc. No.17337 of 2017 (2) dt.09-05-2017 2/2 with Sabel. Babloo Singh took out Rs. 20,000/- from the pocket of Shambhu Singh.

The learned counsel for the petitioners submits that petitioners are, of course, named in the FIR but no specific allegation of assault is made against the petitioners. Considering the facts aforesaid and the nature of allegations made against the petitioners and the fact that occurrence took place due to quarrelling among the children and there is no allegation of assault against the petitioners, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Bikramganj, Rohtas, Sasaram in Surajpura P.S. Case No. 02 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
