Petitioner seeks bail in a case registered for the offences punishable under Sections 306/34 of the Indian Penal Code.
Petitioner happens to be father of co-accused, Sanjeev Kumar Yadav, who allegedly, committed rape on deceased prior to the present occurrence and for the above stated occurrence, the victim lodged Mahila P.S. Case No. 50 of 2015 against the aforesaid Sanjeev Kumar Yadav and others. It is said that petitioner and other F.I.R. named accused went at the door of informant on 29.11.2015 and terrorized the victim for withdrawal
Patna High Court Cr.Misc. No.37411 of 2016 (3) dt.10-11-2016 2/2 of Mahila P.S. Case No. 50 of 2015 which caused depression to the victim, who subsequently committed suicide. Submission on behalf of the petitioner is that even if the aforesaid story assumed to be true, then also, there is no specific overt-act against the petitioner, who is languishing in jail custody since 13.07.2016.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Araria in connection with Jokihat P.S. Case No. 334 of 2015.
