The petitioner is apprehending his arrest in connection with Sheikhpura P.S.Case No. 405 of 2015 for the offences under Sections 27(b), 27(d) of Drugs and Cosmetics Act, 1940.

The allegation against the petitioner is that as per FIR he was running a medical shop without proper licence under Drugs and Cosmetics Act. A statement has been made in para 8 that he is not the proprietor of the medical shop and he came only for purchase of medicine. In para 10 of the petition, a statement has been made that seizure list was not prepared in accordance with law. The petitioner has no criminal antecedent as per

In view of the statements made in paras 3 and 8 of the petition I am inclined to allow the prayer for anticipatory bail of the petitioner.

Let the above named petitioner, in the event of his arrest/surrender in the court below within four weeks from the date of receipt of a copy of this order, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Sheikhpura (Bihar) in connection with Sheikhpura P.S.Case No. 405 of 2015, subject to the conditions as laid down u/s 438(2) Cr.P.C.
