JUSTICE SANJAY PRIYA ORAL ORDER 22-11-2018 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. The petitioner seeks bail in Ariyari P. S. Case No. 54 of 2018 instituted for the offence under Section(s) 363, 366A, 341, 323 and 504 of the Indian Penal Code and Section 4 of the POCSO Act.

Learned counsel for the petitioner has submitted that victim girl, on recovery, has recorded her statement U/s 164 of the Cr. P.C., wherein, she has stated that she had voluntarily gone with this petitioner and also lived with him in Chennai. She has stated in her statement recorded U/s 164 Cr. P.C. that this petitioner had performed marriage with her. She has stated that she will go with this petitioner after attaining the age of majority.

No.67250 of 2018(2) dt.22-11-2018 2/2 In this manner, from the statement of the victim girl recorded under Section 164 Cr.P.C. itself, it appears that victim girl had gone with the petitioner voluntarily. Learned counsel for the informant has appeared and opposed the prayer for bail.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the 1st Additional District and Sessions Judge, Sheikhpura, in connection with Ariyari P. S. Case No. 54 of 2018 subject to the condition that both the bailers shall be the close relative of the petitioner. (Sanjay Priya, J) shyambihari/- U T
