====================================================== CORAM: HONOURABLE MR. JUSTICE SHAILENDRA SINGH ORAL ORDER 28-04-2025 Heard Mr. Bindhyachal Singh, learned senior counsel for the petitioner and Mr. Parmeshwar Mehta, learned APP for the State.
2. Petitioner seeks regular bail in connection with Gardanibagh P.S. Case No. 20 of 2025 dated 08.01.2025 registered for the offences punishable under sections 318(4), 338, 336(3), 340(2) and 112(2) of the Bharatiya Nyaya Sanhita (in short 'BNS') and section 10 of the Bihar Conduct of Examination Act, 1981.
3. The main submissions advanced by petitioner's counsel are that the petitioner is a young person and he has fairly participated in the Central Selection Board of Constable Examination (Advt. No. 01 of 2023) and further, while biometric verification process was going on, he has been falsely framed in this case on the basis of an electronic device, which can not be said to be a conclusive proof to show the complicity of the petitioner in the alleged occurrence. No.20970 of 2025(2) dt.28-04-2025 2/2 been implicated in this matter due to mistake of fact and due to high handedness of the police officials, he was forced to make confession in writing which has no evidentiary value in the eye of law. It is further submitted that the petitioner has fair and clean antecedent and has been languishing in jail since 09.01.2025. It is further submitted that one person, namely, Rajeev Kumar, who is an accused in similar nature of offence relating to Gardanibagh P.S. Case No. 730/2024, has been granted the relief of bail by this Bench vide order dated 11.04.2025 passed in Cr. Misc. No. 17109 of 2025.
4. Learned APP for the State has opposed the prayer of the petitioner.
5. Heard both the sides. Though, the instant matter relates to the serious allegation but considering the petitioner's young age, his fair and clean antecedent, this Court is inclined to grant the relief of bail to the petitioner. Accordingly, let the petitioner named-above be released on bail on furnishing bail bond of Rs.20,000/-(Twenty Thousand) with two sureties of the like amount each to the satisfaction of the court concerned in connection with Gardanibagh P.S. Case No. 20 of 2025.
