====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 09-12-2021 Heard.

The present petition is by way of 2nd attempt at the behest of the petitioner for grant of bail in connection with S.T. No. 343 of 2019 arising out of Amnour P.S. Case No.193 of 2018 for the offence punishable under sections 302/120(B) of the Indian Penal Code in as much as the earlier petition of the petitioner for grant of bail was rejected by a co-ordinate Bench of this Court vide order dated 4.6.2020 passed in Cr. Misc. No. 71102 of 2019. The petitioner is alleged to be the main assailant who had fired on the chest of the son of the informant resulting in his death on the spot.

The learned counsel for the petitioner has submitted that there is no eye witness to the alleged occurrence and the petitioner is languishing in custody

Patna High Court CR. MISC. No.29653 of 2021(2) dt.09-12-2021 2/2 since 13.12.2018.

Per contra, the learned APP appearing for the State has vehemently opposed the prayer for regular bail, made by the petitioner.

I have heard the learned counsel for the parties and perused the materials on record from which it is apparent that there is no change in circumstance so as to warrant reconsideration of the prayer of the petitioner for grant of bail and moreover, the petitioner is alleged to have committed a gruesome murder, hence, I do not find any merit in the case, thus, the present petition is dismissed.
