Heard Mrs. Alka Verma, learned counsel for the petitioner and Mr. S. D. Yadav, learned counsel for the respondent-State.

The petitioner, being a student, has filed the present pro bono petition for the relief as stipulated in paragraph No. 1 of the writ application, which reads as under :- i. For assigning only administrative duty to the senior citizen govt doctors who are above the age of 60 years and exempting them from

ii. For a direction to the respondents to give the seniors citizen doctors a choice posting, in the absence of liberty of voluntary retirement and any leave during COVID pandemic times and also otherwise to enable them to give their best service for which they are ever willing.

iii. For any other relief or reliefs as the Hon'ble court may deem fit.

The abovementioned prayer has been made in view of the Advisory issued by the Ministry of Health and Family Welfare, Government of India and Department of Geriatric Medicine, AIIMS, Delhi for providing health safety measures to Senior Citizens, who are aged above 60 years and specially those whose medical conditions are susceptible to infections, particularly, during the present pandemic COVID-19. The said Advisories have been communicated to the Chief Secretaries of all the States by the Secretary, Ministry of Social Justice and Empowerment, Government of India, as contained in Annexure1 to the writ application. Mrs. Verma, after some arguments, seeks permission to withdraw the present writ application with a liberty to agitate the issue in appropriate proceeding.

Permission is accorded.

Accordingly, the writ application stands disposed of as withdrawn with the liberty aforementioned. However, the disposal of the present writ application

Patna High Court CWJC No.5687 of 2020 dt.22-05-2020 3/3 will not preclude the Additional Chief Secretary-cum-Principal Secretary, Department of Health, Government of Bihar to dispose of the representation of the Indian Medical Association, Bihar State Branch, claimed by the petitioner to have been submitted on 01.05.2020.
