JUSTICE ASHUTOSH KUMAR ORAL ORDER 08-06-2020 The petitioner seeks bail in connection with Khagaria Mufassil P.S. Case No. 157 of 2020, dated 25.02.2020, instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018. 124 litres of liquor is said to have been recovered from the house of the petitioner. From the house of other accused persons also, liquor is said to have been recovered. It has been submitted on behalf of the petitioner that even though the raid was conducted during day time, but no independent person has been made a witness to the raid and consequent seizure of liquor. Regard being had to the facts aforestated, the petitioner above-named is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise), Khagaria in connection with Khagaria Mufassil P.S. Case No. 157 of 2020.

The application stands allowed.
