The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 379/34 of the Indian Penal Code and Sections 25(1-B)a/26 of the Arms Act.
The accusation is of making assault to the informant and snatching of rupees five hundred, gold chain and ring from the informant. One person Rajesh Kumar Thakur was caught with the pistol and when managed to escape from the scene.
It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.38581 of 2015 (2) dt.24-09-2015 2/2 petitioners that on conclusion of the investigation the accusation was found false and final form was submitted but differing with the final form the cognizance has been taken. There is a counter version of the occurrence and father of the petitioners filed case on the same day against the informant and others. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Vaishali at Hajipur in connection with Desari P.S. Case No. 82 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
