JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 363, 365 of the Indian Penal Code.

Petitioner is not named in the first information report but in course of investigation, F.I.R. named accused, Sanju Devi was interrogated and she confessed her guilt disclosing this fact that she had affair with petitioner and deceased being her sister in law used to pass sarcastic comments and subsequently, she with the help of petitioner got murdered the deceased. The call details of petitioner and co-accused, Sanju Devi were collected by the investigating officer and it appears that except the aforesaid

Patna High Court Cr.Misc. No.45972 of 2016 (4) dt.05-12-2016 2/2 confessional statement as well as call details, there is nothing against the petitioner. Co-accused, Sanju Devi, in whose confessional statement the name of petitioner surfaced in this case, has already been granted privilege of bail by a co-ordinate Bench of this court.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that investigation against the petitioner has already been completed, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gopalganj in connection with Mohammadpur P.S. Case No. 186 of 2015.
