Petitioner, who is in custody, seeks bail in connection with Samastipur Rail P.S. Case No. 168 of 2018 registered for the offences punishable under Sections 30(a) of the Bihar Prohibition of Liquor and Excise Act, 2016. Allegation against petitioner is recovery of 48 bottles of foreign liquor containing 180 ml. each from the bag which was carried by petitioner in a train.

It has been submitted on behalf of the petitioner that nothing has been recovered from the conscious possession of petitioner. The Said bag does not belong to him. He has no criminal antecedent and he is in custody since 10.08.2018.

No.67292 of 2018(2) dt.26-11-2018 2/2 Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VI-cum-Special judge (Excise), Samastipur in connection with Samastipur Rail P.S. Case No. 168 of 2018.
