JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 22-06-2015 Heard Mr. Kanhaiya Prasad Singh for the petitioner and learned APP for the State.

The petitioner is the husband of the victim and is facing accusation under Sections 306/34 of the Indian Penal Code. As per the prosecution case, the victim was married to the petitioner in the year 2002. She was tortured by the petitioner and his other family members. Subsequently, she was abetted to consume poison which resulted in her death.

Submission of the petitioner is that the victim was given medical assistance before her death. The post mortem, however, was not allowed to be conducted on the person of the deceased.

Considering the aforesaid fact and the other material

Patna High Court Cr.Misc. No.46386 of 2014 (3) dt.22-06-2015 2/2 emanating from record, I am not inclined to privilege the petitioner with anticipatory bail.

The prayer is rejected.
