2. The petitioner seeks bail in connection with Singhiya P.S. Case No. 16 of 2026 registered for the offence under Sections 103(1) of the BNS.

3. As per the prosecution case, the petitioner is accused of calling the deceased and subsequently, he has found in an injured condition and during the course of treatment, he died.

4. The petitioner is in custody since 13.01.2025.

5. Learned counsel for the petitioner submits that the petitioner is innocent and he has falsely been implicated in this case. He further submits that it has come during

Patna High Court CR. MISC. No.21182 of 2026(2) dt.15-04-2026 2/2 investigation that the deceased had committed theft of Rs. 72,000/- and because of the same he was caught and was assaulted by the villagers and because of the same he died.

6. Considering the aforesaid facts, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned concerned Court below in connection with Singhiya P.S. Case No. 16 of 2026.

8. It is, however, clarified that the observations made herein are limited to the adjudication of the present bail application and shall not prejudice the case of the petitioner at any subsequent stage of the trial and this Court has not expressed any opinion on the merits of the case.
