JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-07-2019 This is an application for grant of anticipatory bail in connection with Baheri P.S. Case No.233 of 2018, disclosing offences under Sections 420, 275, 276 of IPC and Section 27(b((ii), 28, 28(4) of Drugs and Cosmetic Act. Allegation as per F.I.R. is that the Karyana Shop of the petitioner was raided by the police and several medicines were recovered, which the petitioner use to sell without licence and some of them was found expiry medicines.
Submission of the learned counsel for the petitioner is that he has falsely been implicated in this case due to village politics. Further submission is that petitioner is ready to abide by any condition imposed upon him and he is ready to cooperate with the investigation as well as trial, if the charge sheet is submitted against him.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M. IX, Darbhanga, in connection with Baheri P.S. Case No.233 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with further condition that he is to co-operate with the investigation as well as trial, if the charge sheet is submitted against him.
