Learned counsel for the petitioner is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.

This application for anticipatory bail arises out of Excise Case No. 01 of 2018 (P.R. No. 68 of 2018) registered for the offence punishable under Sections 30(a) and 38 of the Bihar Prohibition & Excise Act.

Considering the fact that there is no recovery from the premises of the petitioner and he has been named by a spy, inasmuch as, he has clean antecedent, this anticipatory bail application is allowed.

Let the petitioner, above named, in the event of his arrest/surrender within four weeks from today in the Court

Patna High Court CR. MISC. No.21884 of 2022(2) dt.06-05-2022 2/2 below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Muzaffarur, in connection with Excise Case No. 01 of 2018 (P.R. No.68 of 2018), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is also subject to the condition that the petitioner shall mark his attendance in the Sadar Police Station, Muzaffarpur on first Sunday of every month during the course of the pendency of the case. In default in making his attendance in the aforesaid Police Station, will result into cancellation of bail bonds of the petitioner.
