JUSTICE ARUN KUMAR ORAL ORDER 23-02-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 419, 420, 467, 468, 471 of the Indian Penal Code and Section 138 of the Negotiable Instruments Act. Allegation in brief is that the informant gave friendly loan of Rs.10.00 lacs to the petitioner. In order to return, he paid three cheques of Rs.7 lacs, Rs.2 lacs and Rs.1 lac. All three cheques got bounced when presented in the Bank. Submission is that petitioner and the complainant were engaged in business terms and there was some accounting disputes between both sides as both are on business terms with each other. However, this matter was referred to mediation centre and both
Patna High Court Cr.Misc. No.51164 of 2016 (3) dt.23-02-2017 2/2 sides have amicably settled the dispute and petitioner as per settlement has agreed to pay Rs.1,04,000/- in five equal installments in the bank account of the informant by October, 2017.
Having considered the said facts and circumstances, let the petitioner, namely, Amit Kumar be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Smt. Sangeeta Rani, Judicial Magistrate 1st Class, Patna in connection with Gardanibagh P.S. Case No.106 of 2016 with a direction to discharge the obligation as per the settlement and in case of failure, his bail bond shall liable to be cancelled. (Arun Kumar, J) N.H./- U T
