Learned counsel for the petitioner is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.

This application for anticipatory bail arises out of Dumariya P.S. Case No. 02 of 2022 registered for the offences under Section 30(a) of the Bihar Prohibition & Excise (Amendment) Act, 2018.

Considering the fact that the petitioner has clean antecedent and he has been named in the F.I.R. on the basis of secret informant, inasmuch as the illicit liquor was not recovered from the house of the petitioner, this anticipatory bail application is allowed.

No.22222 of 2022(2) dt.06-05-2022 2/2 Let the petitioner, above named, in the event of his arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Excise Judge No.3, Gaya, in connection with Dumaria P.S. Case No. 02 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is also subject to the condition that the petitioner shall mark his attendance in the Dumaria Police Station, District- Gaya, on first Sunday of every month during the course of the pendency of the case. In default in making his attendance in the aforesaid Police Station, will result into cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) pawan/- U T
