1. Heard the parties.

2. The petitioners apprehend their arrest in connection with Akbarpur P.S. Case No. 453 / 2024 dated 04.11.2024 registered under Sections 3(5), 115(2), 118(2), 126(2), 351(2), 352 of the B.N.S.S.

3. As per the first information report on 02.11.2024 the sons of the informant Gautam Kumar and Lovekesh Kumar were going to attend the nature call. The petitioners surrounded them and the petitioner no. 1 assaulted Lovekesh Kumar with farsa on his head. The petitioner no. 4 assaulted Gautam Kumar on his

Patna High Court CR. MISC. No.21797 of 2025(2) dt.01-05-2025 2/3 head with sword, the petitioner no. 2 assaulted the family members of the informant Ramchandra Chouhan with 'kahara' (sickle) and the petitioner no. 3 assaulted the daughter of informant with iron rod.

4. Learned counsel for the petitioners submits that petitioners and informant are close door neighbour and the occurrence has taken place between them due to quarrel between children. A counter case has been lodged by the side of petitioners against the informant and others bearing Akbarpur P.S. Case No. 452 of 2024. Section 109 of the B.N.S. Act has not been alleged against the petitioners. From perusal of the impugned order it would be evident that injury has been referred to but the learned Additional Sessions Judge -II, Nawada has not mentioned that the injuries sustained by the victims are grievous / serious in nature.

Having regard to the submission made by the parties, taking into consideration the fact that both the parties are neighbour having trivial dispute, case and counter case is there and the injury as referred to in the impugned order does not show that it was serious / grievous in nature accordingly I am inclined to grant anticipatory bail to the petitioners.
