The petitioner seeks bail in a case instituted under Sections 147, 148, 149, 341, 307, 302, 120B of the Indian Penal Code and Section 27 of the Arms Act.
The prosecution story in brief, is that when the deceased Dhanpat Rai and Shambhu Rai were coming after consulting from the APP, in the way, accused persons attacked them with arms and murdered both of them.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 26.11.2015. The charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. General and
Patna High Court Cr.Misc. No.52621 of 2016 (2) dt.16-12-2016 2/2 omnibus allegation has been made against the petitioner. No specific injury has been attributed against the petitioner. The other co-accused have been granted bail vide Annexure-3 series to the present application.
On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-VI, Danapur, Patna in connection with Danapur P.S. Case No.400 of 2015, G.R. No. 3280 of 2015, S.Tr. No. 474 of 2016. (Sudhir Singh, J.) Amit/- U T
